Terms of Service

1. Acceptance of Terms

By accessing or using the Hire Newcomers Canada website and platform (collectively, the “Service”), operated by Hire Newcomers Canada (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account at hello@hirenewcomerscanada.ca.

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or in violation of these Terms.

4. Job Postings

For Employers: By posting a job on our platform, you represent and warrant that:

  • The job listing is for a legitimate, lawful position.
  • The listing accurately describes the job requirements, compensation, and working conditions.
  • The listing complies with all applicable Canadian federal and provincial employment and human rights legislation, including the Canadian Human Rights Act and applicable provincial employment standards.
  • You will not discriminate against applicants on the basis of race, national or ethnic origin, colour, religion, age, sex, sexual orientation, gender identity or expression, marital status, family status, genetic characteristics, disability, or conviction for an offence for which a pardon has been granted.

We reserve the right to review, edit, or remove any job posting that violates these Terms or that we deem inappropriate, misleading, or fraudulent.

For Job Seekers: We do not guarantee the accuracy of job listings or the conduct of employers. You are responsible for verifying the legitimacy of any opportunity before providing personal information or accepting employment.

5. Payments and Refunds

Job posting fees are charged at the time of purchase and are based on the plan selected. All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes.

Payments are processed securely through our third-party payment processor (Stripe). We do not store your full credit card information on our servers.

Refunds may be requested within 14 days of purchase if your listing has not received any applications. After 14 days, refunds are handled on a case-by-case basis. To request a refund, contact us at hello@hirenewcomerscanada.ca.

Plans do not auto-renew. When your plan expires, your listing will be deactivated. You can purchase a new plan at any time to reactivate it.

6. Prohibited Conduct

You agree not to:

  • Post false, misleading, or fraudulent content, including fake job listings or inaccurate profile information.
  • Use the Service to harass, abuse, threaten, or discriminate against any user.
  • Scrape, crawl, or use automated means to access the Service without our written consent.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Upload viruses, malware, or any other malicious code to the Service.

7. Intellectual Property

All content, design, graphics, logos, and software on the Service are the property of Hire Newcomers Canada or its licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit to the Service (such as job listings or resumes). By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with operating the Service.

8. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by applicable law, Hire Newcomers Canada shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Hire Newcomers Canada, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us at hello@hirenewcomerscanada.ca. If you have an active paid plan, termination of your account does not entitle you to a refund unless otherwise required by law.

Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
